How To Participate: Visit www.thingsfestive.com(the "Website" ), and make a purchase through our online store. For the purpose of this Drawing, each month will begin on the first day of the month at 12:00:01 AM EST and end on the last day of that month at 11:59:59 PM EST

Sponsor is not responsible for lost, incomplete, late, damaged, or misdirected prize notifications, or email messages; interrupted or unavailable network, server or other connections including those through and/or by the Website; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Drawing; printing or other errors appearing within these Official Rules or in any Drawing-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic, or otherwise. By making purchases in the specified amounts on the Drawing description page, all customers automatically become Drawing entrants and give their express permission to be contacted by Sponsor by telephone, e-mail and/or mail.

Winner Selection: The winners will be selected in a random drawing to be held on or about the 30th day of the month from among all eligible purchases made during the previous month. The drawing will be conducted by employees of ThingsFestive.com whose decisions are final and binding in all matters relating to this Drawing. Winner will be notified by e-mail using the contact information provided at the time of purchase. Prizes are awarded after the return/exchange period has expired; therefore once prize notification is sent, no returns or exchanges will be accepted. Should drawing winner return an item(s) after being notified of winner status, ThingsFestive.com will not issue a refund nor return items to customer. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within four (4) days of the first notification attempt, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Sponsor will successively attempt to contact up to two (2) potential winners of the prize in accordance with such procedure, and if there is still no confirmed winner of the prize in question after such attempts have been made, the prize may go unawarded.

Prizes/Odds: Three (3) Prizes are awarded each calendar month. One winner will be randomly selected from the following categories: one (1) $150 spa gift certificate for purchases of $100.00 or more; one (1) $100 spa gift certificate for purchases of $50.00 to $99.99; and one (1) $50 spa gift certificate for purchases of $25.00 to $49.99. Gift certificates are non-extendable, and non-exchangeable but may be transferrable. Sponsor reserves the right to substitute a prize of equal or greater value

General Prize Conditions: Prize will be awarded only if the potential winner fully complies with these Official Rules. All applicable federal, state and local taxes are the sole responsibility of the winner. No transfer, assignment, cash redemption or substitution of prizes (or portion of prize) except by Sponsor due to prize unavailability and then for a prize (or applicable portion of prize) of equal or greater value as determined by Sponsor. All details and other restrictions of prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion.

General Liability Release: By participating in the Drawing, each entrant agrees to be bound by these Official Rules and agrees that the Promotion Entities and their designees and assigns: (1) may use (unless prohibited by law) winner's name, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for the purpose of announcing the Drawing winner and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification; (2) shall have no liability and will be held harmless from any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize (including any travel or activity related thereto) or participation in this Drawing or any Drawing-related activity; and (3) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including without limitation, to such prize's quality or fitness for a particular purpose. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate this Drawing (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Drawing and, in the event of termination or suspension, at its discretion, select winners from among eligible, non-suspect entries received as of the date of the event giving rise to such termination or suspension. Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

Governing Law/Jurisdiction: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE DRAWING SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF MICHIGAN WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS.
